And while some people think, “I’ll wait until my business grows before I file,” that delay could cost you more than you realize.

Here’s how that plays out: 🚨 Someone trademarks your business name. 🚨 Now, they own the legal rights to it—if they were using it before you. 🚨 If you were using it first, you may still have rights, but you’ll have to fight for them in court—costing you thousands.
Even if you can prove you were first, legal battles are expensive and stressful. Waiting to file means leaving your brand wide open for unnecessary legal headaches.
One of my clients had been running their business since 2019. Last year, they got the opportunity to put their products in Walmart—a dream come true. That’s when they realized it was finally time to protect their brand and start the trademark process.
When we conducted the trademark search, we found a similar name already registered. We knew immediately that this was going to be an uphill battle.
We anticipated receiving a likelihood of confusion office action, which would be hard to overcome.
If we couldn’t overcome it, we’d need to reach out to the other party for a consent agreement, costing an additional $1,500-$3,000.
If the other party declined, our only option would be to petition to cancel their trademark, which could cost several thousand dollars in legal fees.
All of this could have been avoided if they had filed for their trademark earlier. Instead of facing these obstacles, they could have paid just $2,500 for my trademark package and secured their brand before Walmart ever came into the picture.
Moral of the story? Don’t wait until your big break to protect your brand—by then, it might be too late or cost you way more.
3. Trademark Disputes & Lawsuits Are Costly
